The Changing Landscape in Corporate Criminal Liability for Corruption Offences in Malaysia and the Wider Region

On 1 June 2020, Malaysia saw the implementation of one of the strictest anti-corruption laws in the region including provisions that address both corporations and their executives under the new Section 17A of the Malaysian Anti-Corruption Act 2009.


During this session, benefit from a review of the new corporate and deemed personal liability sections under Section 17A of the Malaysian Anti-Corruption Act 2009 as the speakers also address:

Choo Yi XI

Yi Xi advises and represents clients in matters relating to company law such as disputes between shareholders and directors, commercial fraud, trust disputes as well as in land and property matters. In addition, she also advises clients in matters relating to the anti-corruption legislation.

 

Yi Xi graduated with a Bachelor of Laws (Hons) from Queen’s University, Belfast in 2017 and was admitted as an advocate and solicitor of the High Court of Malaya in 2021.

Tuck Sun’s primary focus is in the area of commercial and corporate litigation and arbitration. He advises clients on shareholders’ disputes and company law related issues, including cross-border disputes. He also advises on competition law, defamation law, IT-related contracts, and telecommunications matters, and handles related litigation. Tuck Sun is also empanelled as an arbitrator with the Singapore International Arbitration Centre and the Asian International Arbitration Centre.

 

In the field of Dispute Resolution, Tuck Sun has been named as a Dispute Resolution Star by Benchmark Litigation Asia-Pacific 2018, as a Leading Individual in the 2018, 2017, and 2016 editions of Chambers Asia Pacific, Recommended Lawyer in the 2016, 2015 and 2013 editions of Asia Pacific Legal 500 and a Leading Lawyer in the 2012 edition of Asialaw Leading Lawyers. He is also named as a Recommended Individual in the 2015 edition of Asialaw Profiles.

 

Tuck Sun is certified as a ‘Tutor Trainer Trial Advocacy’ by the Honourable Society of Lincoln’s Inn (2011) and has been actively involved in the Advocacy training programme run by the Malaysian Bar.

 

His most recent publication is as a Contributing Editor of Malaysian Civil Procedure 2018 and 2013 editions published by Sweet & Maxwell Asia. He is also the Co-contributor and Updating Editor of the Companies (General) Volume in Malaysian Court Forms in Civil Proceedings, published by LEXIS-NEXIS in 2010 and an author of the Computer Crimes Chapter in Halsbury's Laws of Malaysia – E-Commerce (Volume 16(1)) in 2009.

 

Tuck Sun has also given presentations on topics related to commercial and insolvency. To name a few, he gave presentation on civil litigation during the KPMG Seminar on Insolvency Talk for Lenders in Kuala Lumpur in June 2013, co-presented ‘Managing and Drafting International Contracts’ in Global Business Knowledge in 2010 and co-presented ‘Mastering International Contracts’ for Commercial Contracts Masterclass in 2009.

 

Tuck Sun graduated with a Bachelor of Laws (Hons) from University of London (External) in 1995 and was called to the Degree of Utter Barrister of The Honourable Society of Lincoln’s Inn in 1996. He was admitted as an advocate and solicitor of the High Court of Malaya in 1997.
